What is the UK Unmarried Partner Visa?

The UK Unmarried Partner Visa, also called the UK de facto visa, falls under the family visa category. It allows foreign nationals to come to the UK to live with their partner. Both heterosexual and homosexual couples can qualify for this route.

To be able to receive the UK Unmarried Partner Visa, applicants have to prove that they are in a genuine and committed relationship with a British citizen, a person who has Indefinite Leave to Remain status in the UK, or someone who is under humanitarian protection there.

You and your partner also have to intend to live together in the UK on a long-term basis. To be able to do so, you have to have adequate accommodation in the UK.

The validity of the UK Unmarried Partner Visa varies depending on where the foreign partner is applying from. Those who apply for it while being in the UK receive the visa for 30 months. Those who apply from abroad get the visa for 33 months.

What are the UK Unmarried Partner visa requirements?

In addition to being able to prove that your relationship is authentic, you and your foreign partner have to meet the following eligibility requirements for the UK Unmarried partner visa application:

    • Be able to prove that any previous relationships you were in have ended
    • Be at least 18 years old
    • Be able to prove that the person who is in the UK has full British citizenship, Indefinite Leave to Remain, or refugee status in the UK
    • Have been in a relationship for at least two years
    • Have been living together for at least two years at the time of applying
    • Be able to prove that you intend to live together after the foreign citizen arrives in the UK
    • Have accommodation suitable for a couple and any dependents
    • Be able to demonstrate that the non-EEA applicant has a good command of the English language
    • Be able to support yourselves financially as a couple without relying on public funds.

As part of your application for the Unmarried Partner Visa, you will have to submit extensive evidence proving that you meet these requirements.

What are the financial requirements for UK Unmarried Partner Visa?

Being able to financially support yourselves after the foreignpartner arrives in the UK is an important requirement for the UK Unmarried Partner Visa. To be eligible for the visa, you have to meet the following financial requirements of a minimum income threshold as of 2026:

    • £29,000 – the minimum threshold that those living in the UK need to meet for their foreign partner to be able to join them

If your annual income does not meet the minimum threshold, you can also use a combination of other sources, which include:

    • Cash savings
    • Income from renting a property
    • Self-employed income
    • Trust funds
    • Maternity, paternity, or sick pay
    • Pension.

Those who are under humanitarian protection in the UK or live there with refugee status are exempt from this requirement.

Relationship Requirement for UK Unmarried Partner Visa

In order to obtain an Unmarried Partner visa, you will be expected to prove that you are in a genuine and committed relationship with an eligible sponsoring partner. You should expect to be asked for a range of details on your relationship, such as how you met, how often you spend time together, and how long you have been together.

You will also need to provide proof of one of the following:

    • You have been living together for at least 2 years
    • You have been in a relationship for at least 2 years but were unable to live together, for example because of cultural factors or because you studied or worked in different places
      • In this case, you will be expected to provide evidence that you were still in a relationship during that 2-year period, e.g. communication records, evidence of shared finances, and/or evidence of time spent together as a couple

If you are not judged to have provided enough evidence of a genuine and committed relationship, your application for an Unmarried Partner visa will be unsuccessful.

Note that, if you are married to your partner, you can apply instead for a Spouse visa, in which case you can provide your marriage certificate as evidence that your relationship is genuine.

Accommodation Requirement for UK Unmarried Partner Visa

When applying for a UK Unmarried Partner visa, you will be expected to demonstrate that you plan on living with your partner upon arriving in the UK and that they have access to housing which is big enough to accommodate both of you (and any dependants) and which satisfies UK public health standards.

When providing evidence of this, you could use a tenancy agreement or a mortgage statement, for example.

Failure to provide sufficient evidence that you will have access to adequate accommodation during your stay is likely to result in an unsuccessful application.

English Language Requirement for Unmarried Partner Visa

In order to obtain an Unmarried Partner visa, you will generally first need to demonstrate that you have sufficient proficiency in the English language. However, there are certain exceptions to this rule, such as if you have already been in the UK for at least 5 years on a Family visa at the time of application or if your country of origin is an English-speaking country.

When proving your knowledge of English, you can choose between two routes: taking a test or providing evidence of an academic qualification which was taught in English.

    Taking a test

When using the test route to prove your English proficiency, you will need to demonstrate that your English is at least at level A1, according to the Common European Framework of Reference for Languages (CEFR) scale. Note that, if you achieve a level B1 or above, you will also be able to use this result down the line if you eventually apply for UK permanent settlement.

When choosing your test, you should make sure to select an approved English language test provider.

If you are applying from within the UK, the approved providers are as follows:

    • Pearson
    • Trinity College London
    • IELTS SELT Consortium
    • LANGUAGECERT

If you are applying from outside of the UK, you can choose from these providers:

    • Pearson
    • PSI Services (UK) Ltd
    • IELTS SELT Consortium
    • LANGUAGECERT

If you choose to extend your Unmarried Partner visa and you received level A1 in your original test, you will need to achieve at least a level A2 in speaking and listening in your second test in order to successfully obtain your visa extension. However, if you received a level A2, B1, B2, C1 or C2 in your original test, you will be able to reuse your test score, unless it has since been withdrawn by the test provider.

    Academic Qualification

If you have a degree or academic qualification from a UK university or college, you will be able to use this as evidence of your sufficient proficiency in the English language.

If you have a degree or academic qualification which was taught in English but which is from a university or college outside of the UK, you will need to obtain an Ecctis assessment confirming that your qualification is equivalent to at least a UK bachelor’s degree and that English was the language in which it was taught.

Intention to Live Together Permanently in the UK

When applying for a UK Unmarried Partner visa, you will be expected to demonstrate that you and your partner plan to live together permanently upon your arrival in the UK. This still applies even if you were not living together before your arrival in the UK.

The Unmarried Partner visa is intended for couples who, whilst unmarried, are still in long-term and committed relationships. As such, the intention to live together upon your arrival in the UK is seen as an extension of this requirement, as it provides evidence that you and your partner are in a committed relationship. The Home Office, when considering applications for this visa type, will be looking for evidence that your relationship is genuine and committed, and the intention to live together upon your arrival is one way of assessing this.

If living together upon your arrival is likely to be an issue, for instance due to cultural considerations regarding cohabitation before marriage, another possible route you could consider is applying for a UK Fiance visa. This will allow you to marry your partner upon your arrival in the UK, after which point you could apply to switch to a Spouse visa. However, this visa type only has a validity period of 6 months, meaning that you and your partner will have to marry shortly after your arrival.

How long is the UK Unmarried Partner Visa valid for?

The validity of the UK Unmarried Partner visa varies depending on where the applicant is located. If the foreign citizen submits their application from overseas, they will receive the visa for a period of 33 months. If they apply from within the UK, however, their visa will be valid for 30 months.

Those who wish to stay in the UK longer can apply for an extension of additional 30 months before their initial visa expires. To be able to receive the extension, applicants have to meet the same eligibility and financial requirements as before.

The UK Unmarried Partner Visa can be a step towards Indefinite Leave to Remain and permanent settlement. After spending 30 months in the country on top of the initial validity of the visa, its holders will reach the 5-year requirement, which allows them to apply for Indefinite Leave to Remain.

How to apply for Unmarried Partner Visa UK?

The first step of the application for the Unmarried Partner Visa is to submit an online form available on the application website of the Home Office. There, applicants also need to submit the required supporting documents that prove their eligibility for the visa. After that, it is necessary to schedule and attend a biometrics appointment in person.

Applicants can expect to receive the decision regarding their application within 12 weeks of submitting it. If their application is urgent, they can use the priority visa service. Then the application will be processed within 30 working days.

The waiting time for the Unmarried Partner Visa can be longer if applicants fail to include some of the required documents. Hiring an immigration lawyer can help you avoid such delays.

How much does the Unmarried Partner Visa UK cost?

The application fee for the Unmarried Partner Visa varies depending on where the applicants submit their applications from. Those who make an application from outside the UK have to pay £1,938. Those who apply from within the UK, however, have to pay £1,321.

In addition to that, if the foreign partner is coming to the UK with dependent children, the fee for each of them is either £1,938 or £1,321 depending on whether they are applying from inside the UK or abroad.

Supporting Documents for UK Unmarried Partner Visa Application

When applying for an Unmarried Partner visa, you will be expected to provide a variety of documents, both to verify your identity and prove that your relationship is genuine. The documents which you will generally be expected to provide are as follows:

      • Valid passport (or equivalent travel document)
      • Proof of sufficient English language proficiency
      • Proof that you satisfy the minimum financial requirements
      • Proof that your relationship is genuine and at least 2 years old, such as:
        • Bank statement from joint account
        • A letter from your doctor or dentist confirming that you lived at the same address
        • A one-off bill, e.g. home repairs or a vet’s bill
        • Communication records, e.g. shared text messages
        • Proof of joint or shared finances
        • Proof of joint care of any mutual children
        • Proof of time spent together as a couple (e.g. holiday records, joint attendance at events, etc.)

The evidence you use to verify your relationship status should, where possible, come from an official body, e.g. government department, bank, landlord, utility provider, or medical facility. It should demonstrate, where possible, that you cohabited or have shared financial commitments or expenses. It should also be less than 4 years old.

Switch to Unmarried Partner Visa in the UK

If you become eligible for a UK Unmarried Partner visa while in the UK under another visa type, you may be eligible to switch to the Unmarried Partner visa. This would allow you to remain in the UK with your partner and would provide you with a route to permanent settlement and eventual UK citizenship.

For example, if you enter the UK on a Student visa and meet your partner during your studies, and your partner is an eligible sponsor for an Unmarried Partner visa (e.g. is a British citizen or possesses indefinite leave to remain), you can apply for an Unmarried Partner visa after being with your partner for at least 2 years, provided that you meet the additional eligibility criteria (such as the minimum financial requirements). However, if you have not been with your partner for at least 2 years by the time your current visa expires, you will not be eligible to apply for an Unmarried Partner visa. Instead, you will likely need to return to your home country and apply for an Unmarried Partner visa from outside of the UK once you and your partner meet the 2-year threshold.

However, not all UK visas allow the holder to switch to an Unmarried Partner visa, even if the applicant otherwise satisfies the eligibility criteria. If you are in the UK on a Visitor visa, for example, or a visa which is only valid for up to 6 months, it is likely that you will first need to leave the UK before applying for an Unmarried Partner visa.

It is also important to note that, even if you and your partner have been together for at least 2 years, you still may be unsuccessful at switching to an Unmarried Partner visa if you are unable to provide sufficient evidence that your relationship is genuine and at least 2 years old.

For more information on whether you are eligible to switch to an Unmarried Partner visa, contact Total Law today on +44 (0) 333 305 9375.

Extend Unmarried Partner Visa in UK

When you are first granted an Unmarried Partner visa, you will generally be given permission to remain in the UK for 2 years and 9 months. You will then be able to apply for an extension once the initial period of validity comes to an end, provided you continue to meet the eligibility criteria. If your extension request is successful, you will then generally receive permission to remain in the UK for another 2 years and 6 months.

Once you have been in the UK on an Unmarried Partner visa for 5 years, you will then generally be able to apply for permanent settlement status, known in the UK as indefinite leave to remain. This means that you will not need to obtain future visas in order to continue living and working in the UK indefinitely. You will also be able to apply for UK welfare benefits and to access the National Health Service (NHS) without first having to pay the annual healthcare surcharge.

When you have held UK permanent settlement status for at least 1 year, you will then generally be able to apply for British citizenship. If you are successful in your application, you will then be able to participate in UK elections and apply for a UK passport.

Can I Apply for ILR from Unmarried Partner Visa in UK

Yes, the Unmarried Partner visa provides a direct route to indefinite leave to remain (ILR) in the UK. Specifically, once you have lived in the UK under this visa type for at least 5 years, you will then be able to apply for ILR, assuming you meet the additional eligibility criteria.

When you are first granted an Unmarried Partner visa, it will generally have an initial validity period of 2 years and 9 months. Upon its expiry, you will be able to apply for an extension of an additional 2 years and 6 months. Through this route, you can meet the 5-year continuous residence threshold which is necessary in order to apply for UK ILR via the Unmarried Partner visa route.

After at least 1 year of ILR status, you will also generally be authorised to apply for UK citizenship.

                Frequently Asked Questions

If your foreign partner’s application for the Unmarried Partner Visa is successful, they will be able to work and study in the UK. They will be able to start looking for employment and working immediately after they receive their visa.

All foreign citizens who want to come to the UK to join their partner have to prove that they understand English and can speak it. The minimum required level of English is A1 according to the Common European Framework of Reference for Languages (CEFR). To demonstrate that they have it, applicants have to submit evidence showing that they completed an English language test.

Those applying for the UK Unmarried Partner Visa can also make an application for their dependents to enter the country with them. You have to submit the application for your dependents at the same time as your own application.

Keep in mind, however, that bringing dependents comes with additional financial requirements and extra costs.

If your application for the Unmarried Partner Visa is unsuccessful, you can appeal the decision. You have 14 days to do it if you submitted the application from within the UK and 28 days if you applied from abroad.

You have to state the reason why the decision was not the right one and your application should be approved. You also have to prepare supporting documents that prove your argument.

First, you have to submit the appeal to the First-Tier Tribunal. Then, if your application is still not approved, you can apply to the Upper Tribunal.

You should seek advice from an immigration lawyer before undertaking steps to appeal the initial decision regarding your visa.
