Who is eligible for the UK Family Visa?
US citizens who are family members of British citizens and those who have settled status in the UK are eligible for the UK Family Visa. You should apply for the UK Family Visa if you intend to stay in the UK for longer than six months.
If you are a US citizen wanting to apply for the Family Visa, you need to meet one of the following criteria:
- The family member you wish to join in the UK is a British citizen
- The family member you wish to join in the UK has Indefinite Leave to Remain or settled status in the UK
- The family member you wish to join in the UK has refugee status or is under humanitarian protection in Britain.
There are several types of UK Family Visas depending on what your relationship with the person based in the UK is. Each of them comes with different requirements. The main Family Visas you can apply for are:

- Adult Dependent Visa
- Unmarried Partner Visa
What is the Spouse Visa UK?
The Spouse Visa UK allows US citizens to come to the UK to live with their spouse who holds British Citizenship or settled status. If your application for the Spouse Visa UK is successful, you will be able to legally live and work in the UK. At first, your visa will be valid for 33 months, if you are applying from the US, or for 30 months if you are applying from within the UK. After this period it is possible to apply for a visa extension.
If you want to apply for the Spouse Visa UK, you can complete and submit your application from the US. Nevertheless, you will have to come in person to have your biometrics registered. Then, you will need to pay application fees and submit the required supporting documents.
For your application to be successful, you have to meet the following visa requirements for US citizens:
- You and your partner are 18 years old or older
- Your marriage is legitimate in the eyes of the UK authorities
- You can provide evidence showing that you and your partner intend to stay and live together after your arrival in the UK
- You can show that you and your partner will have adequate accommodation after you arrive in the UK
- You can meet the financial requirements.
To meet the financial requirements and be eligible for the Spouse Visa, the person living in the UK needs to have an income of at least£29,000 per year before tax. There are no longer any further income requirements for additional dependents, as of 2024.
What is the Child Dependent Visa UK?
The Dependent Child Visa UK allows US citizens who intend to join their partners in the UK to bring their children with them. If your application is successful, your children will be able to live and study in the UK for as long as the visa have is valid.
If, however, you are a UK national applying to bring your child who is a US citizen to the UK, they will automatically be granted Indefinite Leave to Remain after their arrival.
The main requirement for the Child Dependent Visa UK is for at least one parent to be based in the UK. Additional requirements are:
- The child is younger than 18 years old
- The child is not living an independent life
- The child is not married and does not have their own family
- You are able to financially support the child after they arrive in the UK, without relying on public funds
- You can prove that you and the child are related.
If you are a US citizen applying to join your partner who is a British national or has settled status in the UK and you want to bring your child with you, it is also necessary to prove that taking care of the child is your sole responsibility.

What is the Adult Dependent Visa UK?
The Adult Dependent Visa UK is granted to US citizens who require personal care from their relatives permanently living in the UK. This visa is awarded only if because of age, illness, or disability, the US citizen cannot take care of themselves on their own.
The additional requirements that need to be met for the person to be eligible for the visa include:
- You are 18 years old or older
- You are a parent, grandparent, sibling, or child of someone who has British Citizenship, settled status or is under humanitarian protection in the UK.
- You are able to prove that you cannot get the care you require in the US
- You can prove that the person you intend to join in the UK will be able to support you financially
- You can prove that you will have adequate accommodation after you arrive in the UK.
To apply for the Adult Dependent Visa UK, you need to be in the US. You can submit the application on the GOV UK website. In addition to filling in the application form, you will also need to submit the following documentation:
- Evidence showing that you are related to the person you want to join in the UK
- Evidence that you need long-term care because of age, illness, or disability
- Evidence that you cannot get the assistance you require in the US.
The fee for the Adult Dependent Visa UK is . If the person you want to join in the UK is under humanitarian protection, however, the fee is .
What is the Unmarried Partner Visa UK?
The Unmarried Partner Visa UK allows US citizens who are in a committed relationship with a British national or someone who has settled status in the UK to join them. Both heterosexual and homosexual couples can apply for the visa as long as they can prove that their relationship is genuine and that they intend to stay and live together in the UK permanently.
US citizens applying for the Unmarried Partner Visa need to provide evidence that one of the following statements applies to their UK-based partner:
- They have British or Irish citizenship
- They hold Indefinite Leave to Remain or settled status in the UK
- They are a citizen of a member state of the European Union, Norway, Iceland, or Liechtenstein and were residents of the UK before 1 January 2021
- They are under humanitarian protection in the UK or have refugee status here.
Additional requirements for US citizens wanting to apply for the Unmarried Partner Visa include:
- You and your partner are 18 years old or older
- You and your partner are not related
- You and your partner have a genuine and ongoing relationship
- You and your partner have met each other in person and preferably have lived together
- You and your partner have no ongoing relationships with other people.
For those applying from the US or another country that is not the UK, the application fee is £1,938 . You will also need to pay £1035 for the Immigration Health Surcharge. In most cases, the application processing time is between 10 – 12 weeks. If you need to know the outcome sooner, you can apply for the priority service that costs £500 and allows you to receive the decision within 30 days. If your application is urgent, it is possible to pay £1000 and have it processed within just 24 hours.
What is the Parent Visa UK?
The parent of a UK citizen or permanent resident child can apply for a Parent visa, so that they can raise their child in the UK. However, this comes with additional eligibility requirements that the child must meet. Firstly, they must be under 18 when you apply or were first granted leave. This child needs to be living in the UK as a British or Irish citizen or have settled in the UK, such as through indefinite leave to remain. They can also have pre-settled status as a citizen of an EU nation or Switzerland, Norway, Iceland, or Liechtenstein.
Once you are in the UK, you will have parental responsibility, meaning the child needs to live with you (or be living at a boarding school or university). They also can’t be married or in a civil partnership. This parental responsibility needs to be exclusively yours, unless the other parent is not your partner and is settled in the UK or has British or Irish citizenship. If you are coming to join a partner and child in the UK, you will need to apply for a Partner visa instead.
Alongside your current parental responsibility, you must show that you have had meaningful responsibility for the child in the past. You can use things like a letter from your child’s school confirming your participation in their upbringing or a letter from a health provider confirming you have taken them to appointments. The evidence you provide needs to come from a government, school, medical professional, or court, and cannot be over four years old.
General Requirements for a UK Family Visa
A family visa is for those wishing to join a family member who lives in the UK as a citizen or permanent resident. You will need to have a spouse, partner, fiancé, fiancée, proposed civil partner, child, parent, or relative who will provide for your long-term care to sponsor you. Each of these family visa types has specific requirements that you will need to fulfill to have a successful application.
Some requirements apply to the family member you are joining. Usually, they will need to be one of the following:
- A British or Irish citizen.
- A holder of settled status or indefinite leave to remain in the UK.
- An EU, EEA, or Swiss national with pre-settled status in the UK.
- A holder of refugee status or humanitarian protection in the UK.
- A holder of a Turkish Businessperson or Worker visa.
All UK Family visas also require you to meet stringent financial requirements that ensure you won’t need state support to survive in the UK. This general requirement is detailed in the section below.
Financial Requirements for a UK Family Visa
The UK Family visa has an income requirement for those applying as a spouse or partner of a UK sponsor. This requirement is £29,000 that can be covered by a cash savings requirement of £88,500 held in your account for six months or longer. For other types of family visa, such as the parents of a UK sponsor, there is no minimum income requirement, although the applicant will need to prove that they can support themselves and any dependents while in the UK.
The income for a spouse or partner visa is usually calculated from the sponsor’s existing earnings in the UK. This is most commonly fulfilled through salaried employment, although the sponsor needs to have been working for their employer for six months or longer at a wage above the threshold. Meanwhile, non-salaried employment income is calculated by extrapolating the last six months’ earnings into an annual salary.
Alternative forms of income can also be used for your visa application beyond employment and self-employment income. This includes cash savings over £88,500, pension income and payments, and non-work income, such as rent on properties and payments from dividends.
English Language Requirements for a UK Family Visa
The British Government requires an elementary understanding of the English language to obtain a family visa. It usually requires you to have passed a test for A1 standard or higher on the Common European Framework of Reference for Languages (CEFR). It is also worth getting a test at a B1 level if you are capable, as that is the standard for a settlement application after you have fulfilled your residence period. Furthermore, you also need to pass an A2 speaking and listening test.
Another way to prove English competency is to have an academic qualification taught or researched in English. An Ecctis assessment is needed to prove this if the qualification was not obtained from a British institution.
However, this requirement is waived for US citizens, with the expectation that the vast majority will speak English already. The only case it would be needed is for people living in the USA but don’t have American citizenship, and also don’t have citizenship in any of the other nations for whom the requirement is waived, such as Australia.
Application Process for UK Family Visa
There are multiple stages that you need to carry out to get a UK Family visa. These are listed below:
- Confirm you are eligible.
- Gather documentation.
- Complete the online application form. Submit it alongside your documentation.
- Pay the application fee. Retain the receipt, as this may be needed later in the application.
- Arrange and attend an appointment with a visa application centre to have your biometric information (photograph and fingerprints) taken.

Evidence You Need to Provide in a Family Visa Application
The exact information and documents that you need to provide will depend on the nature of your relationship with the family member that you want to join in the UK. However, the standard requirements include the following:
- The names of yourself, the UK-based family member, and any dependents joining you.
- Your date of birth.
- A valid passport or travel ID.
- Copies of your previous passports’ photo page and visas, and entry stamps.
- Information about your previous immigration applications.
- Information on any previous criminal convictions.
- A national insurance number, if you have one.
- Parents’ date of birth and nationality (for applications from outside the UK).
A range of evidence is also needed to show that you and your UK-based sponsor fit the financial requirements. This can include a bank statement with your income included, six months of payslips, and a letter from your employer. The employer’s letter should include the following:
- Confirmation of employment.
- Job title or position.
- Length of employment.
- Contract type.
- Earnings before tax and national insurance payments.
- Confirmation that payslips are genuine.
Although unlikely for US citizens, a certified translation is needed if you are submitting any documents that aren’t already in English or Welsh. Likewise, a tuberculosis test is required for individuals coming from high-risk nations, for which the USA is not.
UK Family Visa Application Costs
Applying for a UK Family visa is an expensive process, and the application fee will not be refunded to you if your application is rejected. You can also opt to pay extra for priority processing if you need an urgent answer to your visa application. Another significant cost is the NHS Health Surcharge that you can pay to access healthcare in the UK. The fee for a visa holder under 18 at the time of their application is £776. Meanwhile, adult applicants will need to pay £1035.
What Happens After You Apply for UK Family Visa?
Once your application is submitted, all that’s left to do is wait for it to be processed. This will take around eight weeks for those applying as the partner, spouse, child, or adult coming to be cared for by a UK resident or citizen. The processing time extends to 12 months if you are applying as the parent of a UK-based child. Please note that processing times can be substantially longer if your application has issues or the Home Office is experiencing a backlog. You can also pay for priority processing if you need an answer to your application urgently.
Once your visa has been processed, you will receive the result. If it has been accepted, you will have instructions on what to do next and when you can come to the UK. Meanwhile, if your application is rejected, you cannot come to the UK. Your refusal letter will confirm if you have the right to appeal.
