    You can acquire Portuguese citizenship by marriage and join your spouse from India to Portugal if you meet the eligibility requirements.

    This route to Portuguese citizenship is also open for you if you are in a non-marital or de facto union with a Portuguese national for over 3 years.

    The marriage must have been registered with the Portuguese marriage registry for your application to be considered.

    Furthermore, your marriage to the Portuguese national must be current. If you have been married to a Portuguese national for over 3 years but are divorced, you can no longer apply for citizenship.

    Even though you do not need to prove you have a residence permit in Portugal, you still have to show that you have ties to Portugal.

    Who is Eligible for Portuguese Citizenship by Marriage?

    There are some eligibility criteria that Indians need to meet before they can request to obtain Portuguese citizenship by marriage.

    To request for citizenship via the marriage route, you must:

    • Be married to a Portuguese national for more than 3 years.
    • Have your marriage registered in the Portuguese marriage registry. This registration is quite necessary if your wedding was not done in Portugal.
    • Be in a de facto union with a Portuguese national for over 3 years. Note that your relationship with the Portuguese citizen must have judicial recognition by a civil court.

    Grounds for Opposition to Portuguese Citizenship by Marriage

    Here are the grounds on which the Ministry of Justice can refuse citizenship applications on certain grounds:

    Marrying with Citizenship in View

    Some people get into contract marriages or de facto unions with the wrong motive. The sole aim of the relationship or marriage is so the foreign national can apply for citizenship after 3 years.

    Upon acquiring Portuguese citizenship, they file for divorce. If the Ministry of Justice finds out this was the purpose for which your marriage or relationship was instituted, your citizenship application will be refused.

    Criminal Conviction

    Indians who have been convicted of a criminal offence (in India or any other country of residence) in which the penalty is imprisonment for a year or more will have their applications for Portuguese citizenship refused.

    Threat to the Citizens and Residents of Portugal

    If you have a history of or are suspected of constituting a public nuisance, you cannot obtain Portuguese citizenship. Again, if you have been involved in any act of terrorism, you will be denied citizenship.

    Finally, if you have a communicable health condition that will endanger the lives of the people in Portugal, your citizenship application will not be approved.

    False Documents

    You must ensure that every document you present during your application is genuine. All your supporting documents will be verified to determine authenticity. If any of the documents are found to be falsified, your application will automatically be rejected.

    End of Marriage or Relationship with the Portuguese National

    You can only apply for Portuguese citizenship by marriage if you are still in a marriage or relationship with a Portuguese citizen. If you are separated or divorced from a Portuguese national, you should not apply for citizenship because it will be denied.

    Your application to acquire Portuguese citizenship will also be refused if your Portuguese partner has died.

    Military Service in a Foreign Country

    Indians who want to acquire Portuguese citizenship must prove that they have not willingly served in the Indian military or that of any other country. You can only apply if you carried out mandatory military service in a foreign country.

    Lack of Ties to Portugal or Partner

    You must show ties to your spouse or partner for your application to be approved. You also need to show your connection to a Portuguese community. This connection could be evidence that you can speak and understand Portuguese or went to a Portuguese school.

    You are exempt from showing ties to your partner if you already have kids with them.

    Public Functions in a Foreign Nation

    Another ground on which your application can be rejected is if you have performed in any public function in another country without a predominantly technical character.

    If you are found to have broken any of the grounds stated above, the Registrar of Persons will report your case immediately to the Public Prosecutor. The Prosecutor must then file a legal suit against you at an Administrative court.

      Documents And Other Requirements Needed To Apply For Portugal Citizenship by Marriage

      To apply for Portuguese citizenship by marriage, there are certain documents you must submit to prove your eligibility.

      Here are the documents needed for Portuguese citizenship by marriage:

      Criminal Record Certificate

      You must show you have not been convicted of any criminal offence by submitting a criminal record certificate. This certificate must be obtained from India and every other country you’ve spent at least 6 months in the past 5 years. The certificate must not have been issued earlier than 90 days before your citizenship application date.

      Birth Certificate

      You’ll need to present a birth certificate to show that you were at least 18 at the time of your marriage or the start of your relationship. If you have changed names after marriage, you must also present proof that you did so.

      You’ll need to submit the birth certificate of your Portuguese spouse or partner.

      Valid Indian Passport

      You’ll need to submit a copy of your Indian passport. The passport must not have been issued earlier than 10 years from the date of your application.

      You must also submit your spouse or partner’s ID card or passport to prove they’re Portuguese citizens.

      Portuguese Citizenship Request Letter

      When applying for citizenship, you must address a letter to the Minister of Justice in Portugal. In the letter, you request to be conferred Portuguese citizenship. Here are other details your letter must contain:

      • Your name in full.
      • Your birth date.
      • Your residential address.
      • Your nationality.
      • Your civil status.
      • Your occupation.
      • Your lawyer’s name and residential address.

      This letter must be written in Portuguese and signed in the presence of a Registry staff.

      If you send your application by post, you must notarise the letter.

      Evidence of Ties to Portugal

      Here are the documents you need to submit to prove that you have an effective connection to the Portuguese community:

      • Photos of your visit to Portugal.
      • Receipts from airlines, restaurants or hotels proving you have spent time in Portugal.
      • Medical bills showing you have once gotten medical care in Portugal.
      • Membership of a Portuguese club.
      • Property deed showing you have a property in Portugal.
      • Residence history showing you have been living in Portugal for a while.

      Sufficient Knowledge of the Portuguese Language

      To show you are proficient in the Portuguese language, at least up to the A2 level, you have to present any of the following:

      • Certificate showing you graduated from a Portuguese school.
      • Certificate showing you graduated from a school in a former Portuguese overseas colony.
      • CIPLE A2 proficiency certificate from an accredited testing centre showing you have at least an A2 level knowledge of the Portuguese language.

      Marriage Certificate

      You must present a marriage certificate since you are applying for citizenship via the marriage route. You must also show that your marriage was entered into the Portuguese marriage registry if you wedded abroad.

      If you are in a de facto relationship, you must show evidence that you have been cohabiting with the Portuguese national by presenting evidence of shared bills.

      Birth Certificates of Offspring

      Your children’s birth certificates are essential, especially if you are not married or do not have strong ties to Portugal.

      Receipt of Application Fee

      You must attach a receipt showing you have paid the citizenship application fee.

      Signed Application Form

      You must download, complete and then sign the application form. Application packages with unsigned forms will not be processed. You can download the application form at the website of the Portuguese Ministry of Foreign Affairs.

      Note that all your documents must be translated and legalised by an apostille. You’ll have to submit the original and translated copies when applying.

      Fees Associated With The Application

      It will cost you €250 to make the citizenship application. However, you should also be prepared to pay other fees for the issuance of certain documents that you need for your application.

      You may need to pay for the criminal record certificate and the language proficiency test.

      It will cost you some money to get your documents translated.
