What is the Temporary Work Visa in UK?

If you are planning to work temporarily in the UK, it is likely that you will require a Temporary Worker visa. This visa type generally allows you to work in the UK for up to a year, although it can last for up to 2 years in some cases. The specific visa which is best for you will depend on the type of work which you intend to perform. Eligible categories include religious work, charity work, seasonal work, research, work experience, and training.

In most instances, it is possible for your immediate family to join you on a temporary work visa and for you to extend your visa, provided that you continue to meet the eligibility criteria. In both cases, the Seasonal Worker visa is the exception.

Temporary work visas differ from long-term work visas not only in that they allow you to stay in the UK for a shorter period but also in that they do not provide a pathway to UK permanent residence. In order to settle in the UK permanently, you will need to switch to an eligible long-term visa type.

    Types of Temporary Worker Visas

There are a number of Temporary Worker visas available to Turkish citizens, each of which has its own set of rules and regulations. The visa which is the right fit for you will depend on the type of work which you intend to perform and on your personal circumstances.

Some of the main types of temporary work visa available in the UK are summarised in this section.

    Creative Worker Visa

This visa type allows you to work temporarily in the UK in a creative capacity, for example in entertainment, acting, dancing, music, or film.

In order to be eligible under this scheme, you need to satisfy a range of eligibility criteria:

    • You must have both a job offer from a licenced sponsor and your certificate of sponsorship
    • Your employment must stand to make a unique contribution to the UK, for example if you have an internationally established reputation
    • You must have a prospective salary which is at least the minimum salary set by Equity, PACT, or BECTU. Note that this condition does not apply in the case of models, musicians, or circuses
    • You must have sufficient means to support yourself in the UK (generally considered £1,270 in savings).

    Seasonal Worker Visa

Working as a seasonal worker in the UK generally allows you to live and work in the country for up to 6 months. You can work in horticulture (picking fruit, vegetables, and flowers, for example), or poultry. Whilst this visa only allows you to stay in the UK for a short period, you can apply annually.

In order to be eligible, you must satisfy the following eligibility criteria:

    • You must have both a job offer from a licenced sponsor and your certificate of sponsorship
    • You must have sufficient means to support yourself in the UK (generally considered £1,270 in savings)

    Charity Worker Visa

A Charity Worker visa allows you to perform unpaid voluntary work in the UK, working for a charity. In order to be eligible for this route, you must:

    • Have both a job offer from a licenced sponsor and a certificate of sponsorship
    • Have sufficient means to support yourself in the UK (generally considered £1,270 in savings)

    Religious Worker Visa

This visa type allows you to work in the UK in a religious capacity, for example for a religious order or in a non-pastoral role. In order to be eligible to come to the UK under this visa, you will need to:

    • Have both a job offer from a licenced sponsor and your certificate of sponsorship
    • Have sufficient means to support yourself in the UK (generally considered £1,270 in savings)

    International Agreement Visa

This visa type allows you to work in the UK in the capacity of completing work which is covered by international law, or by a treaty. For example, under this visa type, you could work for an overseas government, a recognised international organisation, or in a private capacity within a diplomatic household.

In order to come to the UK on this visa, you will need to meet the following eligibility criteria:

    • Have both a job offer from a licenced sponsor and a certificate of sponsorship
    • Have sufficient means to support yourself in the UK (generally considered £1,270 in savings).

    Government Authorised Exchange Visa

This type of visa allows you to work temporarily in the UK through an approved government authorised exchange scheme. There are a number of these schemes available, which can be found on the website of the UK government. Of these schemes, the work in question might include research, training, or work experience, for example.

There are also a number of potential sponsors, including approved organisations, higher education institutions, or government bodies.

In order to be eligible to come to the UK under this visa, you must:

    • Have a both a job offer from a licenced sponsor and a certificate of sponsorship
    • Have sufficient means to support yourself in the UK (generally considered £1,270 in savings)

This visa is different to the others in the Temporary Worker category in that it will potentially allow you to stay in the UK for up to 2 years. However, it is still considered a temporary work visa.

How to Apply for a Temporary Worker Visa

There are a number of steps which must be completed in order to obtain a Temporary Worker visa. Whilst the exact steps will depend on the type of temporary work visa for which you are applying, they will generally be as follows:

    • First, you will need to obtain a certificate of sponsorship. Your employer will need to be a licensed sponsor in order to provide you with this. They can apply for a sponsor licence on the UK government website, if they are eligible
    • Next, you will need to apply online. This is where you will submit your required documents. You will also need to pay the application fee
    • You will then need to attend an appointment at a visa application centre in order to provide your biometric information (your photograph and fingerprints). In Turkey, these centres can be found in Adana, Ankara, Antalya, Bursa, Istanbul, and Izmir
    • Once you have completed all the stages, your visa application will be processed. If your application is successful, you will then be able to legally enter the UK and proceed with your employment

Required Documents for a UK Temporary Worker Visa

There are a number of documents which you will require in order to apply for a Temporary Worker visa, and the exact combination will depend on the specific visa for which you are applying. However, you will generally require a range of the following documents:

    • Passport
    • Offer of employment
    • Certificate of sponsorship
    • Evidence of sufficient personal savings to support yourself during your stay in the UK (generally £1,270)
    • Evidence of a prospective income which is at least equivalent to the UK minimum wage

Depending on the nature of your application, it may also be necessary for you to provide additional evidence.

Note that your documents will need to be translated into either English or Welsh. If you do need to have your documents translated, make sure that you use a certified translator.

Processing Time for the UK Temporary Worker Visa

As of December 2023, it takes approximately 3 weeks for your Temporary Worker visa application to be processed. However, it can take longer if there are problems with your application, for example if it contains inaccurate information or if the required documents are submitted improperly. Your application may also experience delays if there is a high number of other applications also being processed.

In order to minimise the processing time of your application, make sure that you satisfy all of the eligibility criteria when you first apply and that you have all of the required documents available. If you are asked to provide additional information in support of your application, make sure to do so as promptly as possible.

      Cost of Applying

The application fee for a Temporary Worker visa is generally £298, as of December 2023.

You will likely also need to pay the annual health surcharge, which costs £624. Note that this is set to increase to £1035 in 2024. Paying this surcharge allows you to access healthcare from the National Health Service (NHS).

If you need to get your official documents translated into English, there will also be a cost associated with this. The exact cost will depend on the translation service which you use. Make sure that you use a certified translator.

In some cases, applicants also choose to pay for legal assistance to help with their application. Contact Total Law today on +44 (0)333 305 9375 to learn more about how our own immigration experts can help with this.

Can You Extend the UK Temporary Worker Visa?

It is generally possible for a temporary worker in the UK to apply for a visa extension. In particular, you can extend the Charity Worker, the Creative Worker, the Religious Worker, the International Agreement, and the Government Authorised Exchange visas. You can apply for an extension if you still satisfy the eligibility criteria for your specific visa type.

You cannot extend the Seasonal Worker visa. However, you can reapply for this visa every year in order to perform the associated seasonal work.

Can I Bring Dependents with the UK Temporary Worker Visa?

As a general rule, it is possible to bring your immediate family to the UK when you have a Temporary Worker visa. In particular, you can bring your spouse and dependent children under the Creative Worker, the Charity Worker, the Religious Worker, the International Agreement, and the Government Authorised Exchange visa routes. These family members will be considered your ‘dependents’, and must fall into one of the following categories:

        • Your spouse or partner. If you are not married to your partner, you must prove that you were living together for at least 2 years prior to your visa application
        • Any minor children
        • Any adult children if they are dependent on you

If the visa applications of your dependents are successful, they will generally be granted permission to remain in the UK for the same amount of time as you. If both parents have a UK visa, the children will generally be granted the same amount of time as the parent whose visa expires first

Your spouse and children will not be able to join you if you are in the UK on a Seasonal Worker visa. However, if you give birth when in the UK then it should be possible for you to get valid documentation for your child.

Can I Obtain ILR with a UK Temporary Worker Visa?

ILR (indefinite leave to remain) is the term used in the UK to refer to permanent residence. This means that you are able to live in the UK on an indefinite basis.

It is not possible for a temporary worker to obtain ILR in the UK; the Temporary Worker visa is not an eligible visa type. Instead, you will need to switch to an eligible long-term visa, such as the Skilled Worker visa.

Once you have obtained an eligible visa type, you will generally be eligible for ILR after 5 years of residing in the UK. Note that this will not include any years during which you were living in the UK on a temporary work visa.

                  Frequently Asked Questions

How easy it will be to obtain a UK work visa will depend on your ability to meet the eligibility criteria and provide the necessary documentation. As a general rule, you should be able to obtain a UK work visa if you are able to satisfy all of the necessary criteria, including an offer of employment and a certificate of sponsorship.

However, you may face delays if your application contains incorrect information or is missing necessary evidence. As such, it is important to make sure your application is as strong as possible in order to ensure that your application process runs maximally smoothly.

Note that a certificate of sponsorship is not an actual certificate but is instead a reference number. This reference number links to your personal information and information about your prospective job. It is provided by your sponsor.

Note that your sponsor must be licensed in order to provide you with your certificate of sponsorship.

If you are an employer, you can apply for a sponsor licence on the UK government website.

How long you can stay in the UK without a visa, and indeed whether or not you can do so in the first place, will depend largely on your nationality. For example, citizens of the EU and the US do not need a visa in order to visit the UK for up to 6 months.

However, Turkish citizens will generally always require a visa in order to enter the UK. If you are a citizen of Turkey, it is likely that there is no amount of time which you can legally spend in the UK without possessing a UK visa.

Once you have obtained a visa, the exact amount of time for which you can stay will depend on the type of visa which you hold.

In most cases, you will require a job offer in order to come to the UK on a Temporary Worker visa. Evidence of your job offer will be required at the time of application.

However, in the case of the Youth Mobility Scheme, you can come to the UK without a job offer. In order to be eligible, you must be from a participating country. Whilst Turkey is not one of the participating countries, you may still be eligible if you are a British overseas citizen, a British overseas territories citizen, or a British national (overseas).
