    UK Family Visa Overview

    Foreign nationals whose family members are settled in the UK, may be eligible to apply for a family visa to live in the country for more than six months.

    Turkey is a visa-required country for the UK. So, a Turkish national travelling to the UK to stay there for more than six months with their family member, will have to apply for a UK family visa, provided they meet the eligibility conditions.

    If your family visa application is successful, you will receive a biometric residence permit (BRP) card, and will be able to work or study in the UK (except if you have applied for a UK family visa as a fiancé, fiancée or proposed civil partner). Usually, family visa holders do not get any benefits or access to public funds in the UK.

    Typically, a family visa is valid for a period of 33 months, and can be extended for another 30 months. It might also come with a five year validity in certain scenarios. The maximum validity is, however, six months for people applying as a fiancé, fiancée or proposed civil partner.

    After living in the country for a certain amount of time on a family visa, you may be eligible to apply for settlement, known as ‘indefinite leave to remain’ (ILR) in the UK.

    If you are already in the UK holding a different visa, you may also switch to a family visa to live in the country with your spouse/civil partner, child or parent(s). If your partner is a EU citizen and has a settled or pre-settled status in the UK, you may avail the free EU Settlement Scheme instead.

    Am I Eligible for a UK Family Visa?

    Overview

    Whether you are eligible to apply for a family visa in the UK depends on two conditions: a) your family member’s residency status in the UK, and b) the nature of your familial relationship.

    British citizens, Irish citizens, EEA/Swiss citizens enjoying pre-settled status, people holding ILR or settled status or proof of permanent residence, and individuals with refugee status or humanitarian protection in the UK are eligible to bring their family members to the country on a family visa.

    In addition, spouses/partners of Turkish Businessperson visa holders or Turkish Worker visa holders can also apply for family visas in the UK.

    Only the relatives mentioned below are eligible to apply for family visas:

    • Spouses or civil partners
    • Fiancé, fiancée or proposed civil partner
    • Children
    • Parents
    • Dependent relatives requiring long-term care from their UK family member
    • Widow/widower of a deceased UK resident
    • Separated spouses/partners who have been victims of domestic abuse

    Moreover, if you have already lived in the UK for a certain amount of time, you may be able to apply for a family visa on the basis of your private life.

    Restrictions to the UK Family Visa

    You will not be eligible to apply for a family visa if your family member holds a temporary work visa or student visa in the UK.

    Moreover, you will not be allowed to switch to a family visa if you are in the UK on a visitor visa, or on a visa with six-month validity or less. However, this rule does not apply if you are in the UK on a six-month marriage visa, or have permission to stay in the country awaiting the court decision on a family matter or divorce case.

    Spouse and Partner Visa

    To apply for a family visa as the spouse or civil partner of a UK resident:

    • Both spouses or partners should be adults (i.e. over 18)
    • Your marriage or civil partnership is recognised in the UK, or
    • You are living together in a de facto relationship for at least two years prior to your application, or
    • You are a fiancé/fiancée/proposed civil partner and intend to marry (or form a civil partnership) within six months of your arrival in the country
    • You will be living together permanently in the UK in future

    In addition, you must be able to demonstrate that you/your partner can financially support yourselves and your dependents, and possess a good command over the English language.

    Spouses/partners not meeting the financial or language requirements can still apply for a family visa, in case:

    • They will face significant difficulties if they are to live together as a couple outside the UK
    • Having prevented them from coming to the UK or making them leave the country will amount to a breach of their human rights

      Visa for Children

      Children born in the UK will get the same permission as their parents. They must live with their parents (unless living away from home pursuing a full-time study course), and not be married or in a civil partnership.

      Additionally, minor children born outside the UK must have at least one parent applying for a UK family visa or an extension of their current permission to remain as a partner to the other parent, or as a parent with sole parental responsibility of their children.

      Children above 18 years of age can only apply if they have permission to stay in the UK, which started when they were under 18.

      Visa for Parents

      As a parent, you can also apply for a family visa to care for your child living in the UK, provided the child is either under 18, or were so when you had first been granted leave to remain in the country.

      Additionally, the children must live with you (unless living away from home pursuing a full-time study course), and not be married or in a civil partnership.

      You will also have to prove that you can financially support yourself, your children and any other dependent living with you, and have sufficient knowledge of the English language.

      Parents not meeting the English language and financial requirements may still apply if they have a British or Irish citizen child living in the UK, or a child who has lived in the country for at least seven years and for whom it would be unreasonable to leave.

      Adult Dependent Visa

      To apply as an adult dependent family member, you will have to prove that, because of your medical condition or advanced years, you require long-term care and assistance to perform your daily activities from your parent, child, grandchild or sibling who are living permanently in the UK. Moreover, such care is not either affordable or available in your country of residence.

      Your family member must be able to accommodate and care for you for as long as they have leave to remain in the UK, or for five years if they are British citizens or settled in the country.

      Visa on the Basis of Your Private Life

      To apply for a visa on the basis of your private life, you must be one of the following:

      • Under 18 and lived in the UK continuously for at least seven years, and it would be unreasonable for you to leave the country
      • 18-24 years of age and lived continuously in the UK for more than half your life
      • Over 18, have spent less than 20 years in the UK, and would face significant challenges if you have to leave
      • Living in the UK without interruption for 20 years
      • An individual born in the UK to a parent who is holding permission to remain on the basis of their private life or applying for it currently

        UK Ancestry Visa

        To apply for a UK Ancestry visa, you must belong to one of the following categories:

        • Commonwealth citizen
        • British overseas citizen
        • British overseas territories citizen
        • British national (overseas)
        • Citizen of Zimbabwe

        You should also be able to prove that:

        • At least one of your grandparents was born in the UK, the Channel Islands or the Isle of Man
        • You are over 17
        • You have sufficient financial means to support yourself and your dependents (if any)
        • You intend to, and are eligible to, work in the UK

        How Do I Apply for a UK Family Visa?

        The application process for a family visa in the UK is an online process. Once you have gathered all the required information, please visit the Home Office website to begin your application.

        If you are already in the UK, and you don’t have access to internet services or are not comfortable using a computer or mobile device, you can ask for help with your application.

        Known as ‘Assisted Digital’ support, you will receive support either over phone or in person. However, you will not get any immigration advice. People applying from outside the UK will not be able to get this support.

        While filling up your online visa application form, you can also apply for a visa processing fee waiver if you meet the eligibility conditions.

        What Supporting Documents Do I Need?

        To apply for a family visa in the UK, you will require to submit the supporting documents mentioned below:

        • Passport or any other travel ID
        • Copies of passport biometric page and any previous visa or entry stamps
        • Copy of your BRP card, if applicable
        • Your tuberculosis test results if applicable depending on your country of residence
        • Proof of subsistence
        • Documents proving your knowledge of English language
        • Documents showing the residency status of your family member in the UK
        • Proof of your relationship with your UK family member
        • Any other relevant documents supporting your reason(s) for applying for a UK family visa, e.g. medical documents showing an illness or disability for which your relative in the UK must take care of you etc.

        Please note that since Turkey is a member of the Hague Apostille Convention, your official documents do not need to be legalised. However, if your documents are not in either English or Welsh, you will have to submit certified translated copies.

        Please also note that the Home Office may ask you for additional supporting documents depending on your immigration situation.

        UK Family Visa Processing Time

        It may take up to 24 weeks to receive a decision on your family visa application, if you are applying from outside. If you are applying in the UK, you may get a decision within eight weeks.

        In the latter case, you may have the option to avail the super priority service by paying an extra £1,000, to get a visa decision faster than that. Adult dependents joining their UK relatives cannot avail this service.

        Applicants in the UK who don’t meet the language and financial requirements, may have to wait for up to 12 months to receive a decision.

          Family Visa UK Cost

          For spouses/partners, children or parents joining the UK resident, each application will cost £1,048 if applying within the UK, and £1,846 if applying from outside the country.

          For other adult relatives who must be looked after by their UK family member, the cost will be £1,048 if they are applying in the UK, and £3,250 from outside the country. The latter will be reduced to £404 if your family member has a refugee or humanitarian protection status.

          In addition, a healthcare surcharge at the below rate may have to be paid to obtain a family visa:

          • If you are staying in the UK for 30 months, then:
            • £1,560 for adults
            • £1,175 for children (i.e. under 18)
          • If you are staying in the UK for 33 months, then:
            • £1,872 for adults
            • £1,410 for children
          • If you are staying in the UK for five years, then:
            • £3,120 for adults
            • £2,350 for children

          The family visa fee may be waived for people who do not have a living place, or cannot afford their essential living expenses, or have an income so low that paying the visa fee will harm their children’s wellbeing.

          If your family visa application is rejected, the Home Office will send you a decision letter detailing the reason(s) thereof. It will also inform you whether you can appeal that decision or ask for an administrative review.
