    What is the Spouse Visa in the UK?

    The UK Spouse Visa, also known as the Marriage Visa or the Partner Visa, is one of the visas under the Family visa category.

    If you’re married to a UK citizen, settled person, pre-settled person, and Turkish Businessperson or Turkish Worker Visa holder, the Spouse Visa will allow you to migrate to the UK to be with your spouse or civil partner.

    If your partner lives outside the UK, you can also apply for a Spouse Visa, provided they intend to return to the UK with you.

    It’s important to note that your marriage to a UK national doesn’t automatically grant you permission to enter the UK or citizenship status. You must first apply for a Spouse Visa and live in the UK for a specific period before you can qualify for indefinite leave to remain (ILR) and, eventually, citizenship.

    Requirements for a Spouse Visa UK

    Before applying for the UK Spouse Visa, you must meet all eligibility requirements to ensure a successful application. The requirements for a Spouse Visa application include:

    • You and your spouse must be 18 or over
    • Your partner must either:
      • Be a British citizen
      • Be an Irish citizen
      • Have settled status, such as indefinite leave to remain
      • Be a person with pre-settled status
      • Have a Turkish Businessperson Visa or Turkish Worker Visa
      • Have protection status, such as leave to remain or permission to stay as a refugee or a person with humanitarian protection
    • You must be in a civil partnership or marriage that is recognised in the UK
    • You and your partner must have a genuine and subsisting relationship
    • You must have lived with your partner for at least 2 years before applying
    • You and your partner must intend to live together permanently when you arrive in the UK
    • You and your partner must satisfy the financial requirement
    • You must have suitable accommodation in the UK
    • You must meet the English language requirement

    The Minimum Financial Requirement for the UK Spouse Visa

    As part of your application, you and your partner must prove that you meet the minimum financial requirement.

    This means you must have a combined annual income of at least £18,600 if you have no children. If you have children, you must earn an additional £3,800 a year for your first child and £2,400 a year for each child you have after your first child.

    To prove your income, you and your partner can use the money earned in the UK for 6 months or more from employment before tax and National Insurance and self-employment. You can also use cash savings if it is above £16,000, earnings from a pension, and money from property rentals or dividends.

    The UK government recently announced changes to the minimum financial requirement, stating that it will increase incrementally in stages.

    Starting in spring 2024, the minimum income threshold will move from £18,600 to £29,000, currently the 25th percentile of earnings for eligible skilled jobs. It will move to the 40th percentile, currently ​​£34,500, and finally to the 50th percentile, which is currently £38,700.

    English Language Requirements for Partners

    As a Turkish national, you will be required to prove your knowledge of the English language when applying for a UK Spouse Visa.

    There are two ways to prove your knowledge of English: with an academic qualification or by taking a test.

    Your academic qualification can be from a UK higher institution or one outside the UK. If your certification is from a non-UK school, you must prove that it is equivalent to a UK bachelor’s degree or higher and that it was taught in English.

    On the other hand, you can take an approved English language test that is at least at a level A1 on the Common European Framework of Reference for Languages (CEFR) scale.

    However, you will be exempt from this requirement if you are over 65 or have a physical or mental condition that prevents you from taking a test.

    Accommodation Requirements for UK Spouse Visa

    You must prove that you have adequate accommodation where you and your spouse will live. An ‘adequate’ accommodation means that where you intend to stay must:

    • Be owned or occupied exclusively and legally by you and your family
    • Be obtained without recourse to public funds
    • Not currently, and will not be overcrowded
    • Not breach public health regulations

      How to Prove Your Relationship

      You and your spouse must prove that your relationship is genuine and subsisting and was not created for immigration purposes.

      The Home Office makes decisions on whether relationships are genuine and subsisting on a case-by-case basis. They will consider all evidence and your individual circumstances when reviewing your application.

      Some factors that the Home Office will consider include:

      • Whether you’re in a long-term relationship
      • If you have any children together
      • Whether you have shared financial responsibilities
      • Whether you have physically seen and visited each other
      • Whether you have made plans concerning your living arrangements in the UK

      Any evidence you submit should meet the following requirements:

      • Be less than 4 years old
      • Come from the government, a bank, a landlord, a utility provider, or a medical professional
      • Clearly confirm that you and your partner live together, share expenses or are legally married
      • Show that any previous marriages or civil partnerships have been dissolved

      You can submit documents such as your marriage certificate and any of the following that confirm you live at the same address:

      • A tenancy agreement, utility bill, or council tax bill establishing that you live at the same address or pay bills together
      • Bank statement from a joint bank account showing you live at the same address
      • A letter from your doctor or dentist

      You can also submit the birth certificates of the children you have together ( biological or adopted), evidence of your correspondence over the years (like text messages), travel tickets from visiting each other, and receipts of gifts you’ve bought each other.

      Documents Required for the UK Spouse Visa Application

      You should provide the following documents when making an application:

      • Your current passport or other valid travel document
      • Copies of the photo page and any visa or entry stamps in your previous passports
      • Proof of your spouse’s right to be in the UK with documents such as their British passport
      • A letter of sponsorship from your spouse
      • Proof that you meet the minimum financial requirement with any of the following:
        • Bank statements showing you or your partner’s income or savings
        • 6 months of payslips
        • A letter from an employer, dated and on headed paper
      • Proof of adequate accommodation with the following
        • Property deeds or lease agreement
        • A written note accurately describing the property from a housing authority
        • Detailed report of the occupants of the property
        • A property inspection report from a local authority
      • Documents showing proof of a genuine and subsisting relationship
      • Evidence that any previous marriages have ended, with documents like divorce or death certificates

      • Details of any criminal convictions

      If your documents are in Turkish or any other language besides English, you must ensure you translate them through a Home Office authorised translator.

      How to Apply for a Spouse Visa UK from Turkey

      Once you’ve determined that you meet the criteria and have gathered the required documents, you can begin the application process for the UK Spouse Visa. Here’s a step-by-step guide on what to do:

      Apply Online

      The application process usually starts online. You should visit the UK government website and create an account to begin your application.

      You will be required to fill out the visa application form and provide your personal details and your spouse’s. You must also upload all supporting documents and pay the visa application fee.

      Arrange an Appointment

      Once you submit your online application on the UK government portal, you will be asked to book a biometric appointment with the visa application centre(VAC) in Turkey.

      On the day of the scheduled appointment, visit the VAC with all supporting documents you used for the online application. An official will take your biometric information (fingerprints and photographs) and review your documents.

      The official may ask you questions regarding your application, including details of your relationship and other related questions.

      Receive a Decision

        Applying with Your Children

        If you intend to move to the UK on a Spouse Visa with your children, you can add them as dependents on your application.

        Any child added to your application must:

        • Be under 18 at the time you apply
        • Not be living an independent life, such as being married, living away from home (except for studies), or being a parent themselves

        If your child is below 14 years, they will not be required to attend the visa interview.

        UK Spouse Visa Application Fee from Turkey

        You will be asked to pay a visa processing fee of £1,846 during your online application. If your dependents are applying with you, they’ll each pay the processing fee.

        Immigration Healthcare Surcharge

        You will also need to pay the immigration healthcare surcharge. The amount you’ll pay will depend on your age and permission to stay.

        You must pay £1,872 if you’re staying for 2 years and 9 months and £3,120 if you’re staying for 5 years. Each of your dependents under 18 will pay £1,410 if staying for 2 years and 9 months and £2,350 if staying for 5 years.

        How Long it Takes to get a UK Spouse Visa

        It will typically take 24 weeks to receive a decision on your UK Spouse Visa application after applying online.

        It can take longer to get a decision if the Home Office needs more information from you or there is a backlog of cases they’re handling.

          Duration of a UK Spouse Visa

          If your UK Spouse Visa application is successful, you will be able to stay in the UK for 2 years and 9 months (33 months). When your visa expires, you will need to apply for an extension.

          Can you Work on a UK Spouse Visa?

          You will be able to work full-time and without restrictions in the UK on a Spouse Visa. You can also start a business or be self-employed.

          Extending your UK Spouse Visa

          You can apply for an extension of your UK Spouse Visa, but you must do so before your current permission to stay expires, usually within 28 days of the expiration date.

          To apply for an extension, you must continue to meet the initial conditions of your visa. You will also need to make an application online through the UK government website.

          You must submit all supporting documents you used during your initial application and pay the extension application fee of £1,048.

          The Spouse Visa extension application should take about 8 weeks to process. If your application is successful, you will be allowed to stay for an additional 2 years and 6 months (30 months).

          Spouse Visa to Indefinite Leave to Remain

          If you’ve lived continuously in the UK for 5 years on a Spouse Visa, you may be eligible to apply for settlement or indefinite leave to remain (ILR).

          To qualify for ILR, you must:

          • Have lived together with your spouse since you last renewed your visa
          • Intend to remain married to them after you attain settled status
          • Prove you meet the English language requirements with at least a B1 level certificate and pass the Life in the UK test if you’re less than 65

          The earliest you can apply is 28 days before you meet the requirement for time spent in the UK. Note that if your UK Spouse Visa expires before you can apply for ILR, you will need to renew your visa first.

          With your settled status, you can live, work, and study in the UK for as long as you like. You can also apply for public or government benefits if you’re eligible.
