In October of 2022, the Spanish government passed what is referred to as the Grandchildren’s Law.
Thanks to this, Spanish citizenship by descent is now not only available to children with Spanish parents but also to grandchildren of Spanish nationals.

Ancestry Requirements for Citizenship by Descent in Spain
To be eligible for Spanish citizenship by descent you must have a close relative such as your parent or grandparent who were Spanish citizens.
At a glance, one or more of the following should apply:
- You have a Spanish father or mother
- You have a grandparent who is a Spanish national
- Both of your parents were born in Spain
- You have an adoptive parent who is a Spanish national – You were adopted before you turned 18 years old
- You are Latin American and have a grandparent who was born in Spain
- Your Spanish ancestors have citizenship in Spain
Usually, you will need to prove your relationship to a close family member with Spanish roots to qualify. This will normally be a parent or grandparent but under some circumstances, a different legal guardian who had official custody of you before you turned 18 years old also counts.
You may also apply if you have a grandmother who was born in Spain but married a foreign national before the 1978 constitution came into effect.
If you were born outside of Spain because your parents or grandparents who had Spanish nationality were exiled and had to leave Spain you may also qualify. You will have to provide evidence of these circumstances and your relationship to your Spanish relative when applying.

Documents Required for Spanish Citizenship by Descent
When applying for a Spain citizenship by descent permission, you will need to prove that you qualify by providing a selection of documents as evidence.
Depending on your application path and familial circumstances, the documents may vary greatly, but in general, the goal is to confirm your personal details and to prove your relationship to a qualifying Spanish relative.
You will need the following documents:
- Your valid passport
- Details of any current residential permits you might have
- Your signed application form
- Your birth certificate
- The birth certificate of your Spanish parent or grandparent. (Issued by a Spanish Civil Registry, a foreign Civil Registry, a consular, or a municipal)

Applying for Spanish Citizenship by Descent

Applying for a Spanish passport usually costs €30.

Applying for Spanish citizenship by descent can be a lengthy process and you should expect for your application to take months and up to two to three years.

Spanish Citizenship Tests
Overview
When applying for Spanish citizenship by descent, you will need to pass two main citizenship assessments which will test your ability to speak and understand the Spanish language (this is the DELE or DELE A2 test) and your knowledge of Spanish society and culture including the country’s history, customs, and constitution (this is the CCSE test).
To be eligible, you will need to achieve a passing score on both tests. You will need to pay €130 for the DELE test and €85 for the CCSE test, which will give you two attempts for either Spanish citizenship test.
The DELE A2 Test
The DELE test, also called the Diploma of Spanish test, is designed to evaluate your ability to navigate life in a Spanish-speaking country. You will be tested on your ability to understand and utilize Spanish at an A2 pre-intermediate language level.
You should note that you may not need to complete this test if you can prove your language skills otherwise, such as if you have taken an adequate class in college or if you are from a Spanish-speaking region.
The test involves two parts, one where you will be tested on your reading comprehension, and another where you will need to show your writing and interaction skills.
Completing both parts of the DELE A2 test is expected to take about two and a half hours.
The CCSE Test
The CCSE or Constitutional and Sociocultural Aspects of Spain test (Conocimientos Constitucionales y Socioculturales de España) is designed to test how well you can integrate into Spanish lifestyle and society.
You will need to answer questions about Spanish culture and history, as well as present an awareness of Spain’s general constitution and laws.
The CCSE test takes about 45 minutes to complete.
Dual Citizenship in Spain
Unfortunately, Spain generally doesn’t allow dual citizenship for foreign nationals who are applying to obtain Spanish citizenship. As a US citizen, you will have to give up your US citizenship if you want to obtain citizen status in Spain.
Some exceptions are made for citizens of certain areas, including EU and EEA nationals and citizens of a Spanish-American country, including Andorra, Equatorial Guinea, or the Philippines. If you are simply a US resident but have one of the above nationalities, you may be eligible for Spanish dual nationality.

Alternative Ways to Apply for Spanish Citizenship
If you do not qualify for Citizenship by descent, you might still have other options. Generally, Spanish citizenship is offered to most foreign nationals who come and live in the country for a minimum number of years.
To do so, you will need to first obtain one of the available national visas, which will permit renewable temporary residence for up to five years. You may qualify through work, studies, or family, as well as through investments or if you can live without the need for additional income.
After five years this permission can be upgraded to a permanent residence permit and after another five years, you will usually be able to apply for Spanish citizenship.
Alternatively, you may also qualify without the ten-year residential minimum if you are married to a Spanish national. In this case, you may apply for naturalization after one year of living in Spain with your spouse, provided that you can show evidence that your relationship is real and ongoing.
Considering marriage just to obtain citizen status is unlawful and has serious legal consequences with the Spanish authorities, so do not try this.
Finally, there is also Spanish citizenship by option, but the requirements are similar but stricter than citizenship by descent so if this is not the right route for you, citizenship by option likely won’t be either.
