    The legal application procedure is as follows:

    Get Married

    To be eligible for citizenship through marriage, you must be legally married to your Spanish citizen partner, who must usually be a citizen by birth, and obtain your marriage certificate. Please note that civil partnerships (called ‘pareja de hecho’ in Spanish) do not qualify for citizenship, and civil union partners must gain citizenship through another citizenship route.

    You can get married in Spain or abroad. You are allowed to get married in Spain even on a tourist visa with no residency. If you get married in Spain, your marriage will be automatically registered and accepted by the Spanish government, however, if you get married abroad, you must register your marriage officially at the Spanish civil registry or a notary office once you are in Spain.

    Obtain a Spanish Residency Permit

    Once you are married to your Spanish spouse and are in Spain, you must then obtain a valid residence permit. The first date of validity on your residence permit will be the start day of your year-long requirement of living in Spain in order to be eligible for Spanish citizenship.

    There are two types of Spanish legal residence permits available to you as a married partner of a Spanish citizen, and both are valid for a residency period of 5 years:

    • The ‘Tarjeta Communitaria’ (Family Member of an EU Citizen card) – obtaining this card includes needing to provide evidence that you have sufficient financial means to live in Spain
    • The ‘Family Arraigo’ residence permit – this is provided in more complex circumstances and includes the need to complete a criminal background check.

    Live in Spain for 1 Year

    Once you are married, have officially registered your marriage, and have applied for and obtained a Spanish residence permit, you must now live with your spouse in Spain for 12 consecutive months.

    You can prove cohabitation with your spouse in Spain through submitting the following types of documents as part of your Spanish citizenship application:

    • Rental agreement, with both names signed
    • Visa status
    • Residence permit
    • Utility bills, addressed to both parties.

    If you were previously cohabiting in Spain before you were married, this will not be counted towards your citizenship by marriage application, as your 1 year residency period eligibility is based on time spent living in Spain as a married partner of a Spanish citizen.

    Once you have completed all the steps outlined above, and have legally resided in Spain for 12 months as a person married to a Spanish citizen, you are now eligible to apply for citizenship.

      Document Requirements for Spanish Nationality By Marriage?

      To apply for Spanish citizenship through marriage, you will need to submit the following documents, which must all be translated into Spanish:

      • Valid passport
      • A Recent passport photo
      • Foreign Identity Number (NIE)
      • Residence Permit (TIE), proving you have lived in Spain for 12 consecutive months since the start date of the validity period
      • Birth certificate
      • Proof of legal residence cohabiting with your Spanish spouse as a married couple in Spain
      • Clean criminal record certificate (covering the last 5 years)
      • Health insurance coverage
      • Marriage certificate to your Spanish spouse, and any divorce certificates that may be required to prove any previous marriage either of you had was dissolved before your current marriage
      • Proof of passing the DELE A2 Spanish language exam
      • Proof of passing the CCSE cultural knowledge exam
      • Proof of financial self-sufficiency, such as payslips or bank statements proving you meet the IPREM requirements (outlined below)
      • Application fee – approximately €60-€100 ($65-$110 USD).

      Financial Requirement for Citizenship

      To become a Spanish national, you must demonstrate financial self-sufficiency. The Spanish system uses the IPREM (Public Multiple Effects Income Indicator) to assess your income level. The IPREM score requirement is that you must earn at least 150% of the current IPREM. This translates to approximately €900 per month (150% of the base €600/month), equating to approximately $100.
