    The France talent passport permits UAE businesses and employers to create a company or take over one in France. It is also a permit that allows you to invest in France or develop a project of high economic value in the country.

    The talent passport is a broad visa category that has the following visas:

    • Talent passport for qualified employees.
    • Talent passport-innovative company.
    • Talent passport – EU Blue Card.
    • Talent passport- employee on assignment.

    You can apply for a long-stay residence permit (VLS-TS) with the inscription “passeport talent” if you will not stay more than 1 year in France.

    Eligibility & Requirements For The France Talent Passport

    To apply for the talent passport, there are certain criteria that you must meet. The requirement you must meet depends on what you want to do in France.

    Talent Passport France Requirements for a Business Creation

    To create a business or take over the running of an existing one in France, you need to present the following:

    Evidence of Experience

    UAE business creators must show they have a master’s degree or at least 5 years of experience in their field. Your master’s degree certificate or a resume showing 5 years of experience will suffice.

    Business Project

    You must show that you have a business project you want to implement in France. You can prove this by presenting a business plan and your budget for running the company for at least 4 years. You can also show evidence that you have purchased a sizable stake in an existing business in France and, as such, now have control of the said business.

    The business can be industrial, artisanal or commercial in nature.

    Investment

    You must also show that you have invested or have at least €30,000 to invest in the business. You can prove you have the money in an account that bears your name. It is also acceptable to show that you have borrowed the funds from a credit institution in France.

    UAE Passport

    You must submit a valid UAE passport to prove your identity and nationality. The passport should have at least 2 blank pages where your visa will be attached.

    Proof of Domicile

    If you are not in the UAE at the time of application, you must prove you’re a legal resident where you are.

    Passport Photographs

    You must submit 3 recent passport photos.

    Visa Application Form

    You also need to complete a visa application form.

    Criminal Record Certificate

    You must obtain a criminal history certificate from the Police in UAE and every other country you have spent at least 3 months in the past 5 years. The criminal history certificate must not have been obtained earlier than 90 days from your application submission date.

    Business Premises

    You have to show that you have a place where the business will be situated. This can be proven by submitting a document that shows you have leased, sub-leased, rented or bought a space for business in France. If you are taking control of a business, you must get the documents that authorised the previous owner to do business in that space.

    Articles of Association

    UAE businesses will have to show that their business has been duly registered in France and that the directors and shareholders of the company have been set up. Your business must have status, a SIREN number and a K-extract.

    Proof of Financial Means

    You must show you make an annual income of at least €20,814.73.

    Visa Fee Payment

    You must present the receipt that proves you have paid the visa application fee.

      Requirements for the UAE Economic Investor

      UAE businesses or employers who wish to invest in a company situated in France through their overseas business must meet the requirements below:

      Ownership of Company

      To be regarded as an economic investor, you must prove that you run or own at least 30% of the business through which you’ll be investing.

      Job Creation

      You must show how you plan on creating jobs within 4 years of investing.

      Investment Sum

      You have to prove that you are investing at least €300,000. The amount could be in the form of cash or assets. You can also show that you have borrowed funds from a credit institution for this purpose.

      Passport

      You must present a valid UAE passport.

      Proof of Domicile

      If you are not currently residing in the UAE, you have to prove you are a legal resident where you are.

      Photograph

      UAE businesses or employers who want to set up an innovative economic project must meet the following criteria:

      Passport

      You must present your UAE passport to prove your identity and nationality.

      Proof of Domicile

      If you have been staying in another country, you must show you are a legal resident there.

      Endorsement by a Public Body in France

      A public body in France must recognise how innovative your idea is. They will issue you a statement acknowledging the project.

      You must show you have enough money to stay in France, at least €20,814.73.

      Visa Fee Payment

      You must pay the visa fee; otherwise, your application won’t be processed.

        France Talent Passport: Step By Step Application Process

        Below is the step-by-step application process for the France talent passport:

        Prepare Your Documents

        The document you are required to submit depends on the category of the talent passport that you are applying for. You can use the documents/eligibility requirements section as a checklist.

        Apply Online

        The next step is to visit the Ministry of Interior and fill out the application form for a long-stay visa. The form must be printed and signed, as unsigned application forms will prevent your visa application from being processed.

        Schedule Document Submission

        After getting the application form, you can schedule a date to drop off your documents at the French Embassy in Abu Dhabi. You must make an appointment, as the French Embassy does not accept walk-in submissions.

        Ensure you take all your supporting documents with you. If your documents are in Arabic, you must have them translated and legalised. You can also get both services at the Embassy for a fee.

        You must submit the original and translated copies of your supporting documents.

        When you arrive at the Embassy, an officer will review your documents. After they are satisfied with your submission, they will collect your biometrics.

        Pick Your Visa

        If your application is successful, you will be told when and where to pick up your passport. Only after a visa approval should you move to France.

        Residence Permit Application

        Upon arriving in France, you must have your visa validated into a VLS-TS if you are staying for less than 12 months. If you intend to stay for more than 12 months, you must apply for a residence permit. The application for a residence permit is done online at the French Ministry of Interior’s website.

        It is vital to note that you must validate your visa into a VLS-TS or switch to a residence permit within 4 months of entering France. If you fail to do this, you will become an illegal resident and could be forcefully removed from France.

        Immediately you apply for the residence permit online, you will get a dematerialised certificate deposit. This certificate proves that you have applied for a residence card. Once you have the dematerialised certificate, you no longer need to worry about forceful removal until you get a decision on your residence permit application.

        Usually, your residence permit should be out within 3 months of your application. However, if for any reason it is not, you will need to contact your prefecture or sub-prefecture to extend the dematerialised certificate deposit.

        It is also important to note that you cannot leave the Schengen area if your visa has not been validated into a VLS-TS. You can only leave and re-enter France (Schengen zone) if you have validated your visa. You may not be allowed re-entry into the country if you break this rule.

        Issuance of a Residence Permit

        Your prefecture or sub-prefecture will issue you a residence card. You will need to pay €225 for the issuance.

          The Requirements For Family Joining The Applicant

          Your spouse and child under 18 can join you in France while on the talent passport. Other family members who want to come to France must apply for another family reunification visa.

          If you wish for your family members to join you in France, they’ll need to apply for the Talent Passport- Family.

          Your family members must prove that their relationship with you is genuine. Your spouse must submit a marriage certificate, while your minor child must present a birth certificate.

          When your spouse arrives in France, they can change their visa to a multi-year talent passport-family residence permit. This permit gives them the right to work without needing an employer to get work authorisation.

          Your minor child will not be able to work. However, they can apply for a residence permit and work when they turn 18.

          It will cost your spouse €269 to get the residence permit. It will cost each additional family member €99 for the permit.

          You’ll need to prove to the French authorities that you can take care of the family size coming to join you in France.

          Validity Period Of The France Talent Passport & Renewal Options

          The minimum you can stay on a France talent passport is 1 year.

          The maximum you can stay on a France talent passport is 4 years.

          You can renew the France talent passport in France. The earliest time to submit your renewal application is 4 months before your residence permit expires.

          The latest time to submit your renewal application is 2 months before your permit expires.

          The renewal application is done online. You have to scan and send in all the documents you used to apply for the residence permit initially.

          You will need to add your French address and your soon-to-be-outdated residence permit. You must also present proof that you have been paying taxes and contributing to social security since you started living in France.

          You will also pay the same fees you paid when making your first application.

          What if My Residence Permit Application is Refused?

          There are 2 ways to know that your residence permit application was refused.

          They are:

          Outright Notification of Refusal

          If your application is refused, you may get a letter explicitly explaining the reasons for the refusal. In this case, you will be given time to leave France. The Obligation to Leave French Territory (OQTF) and the refusal decision can be appealed at an administrative court within 2 to 30 days, depending on how much time you have.

          No Response

          If the prefecture has not informed you of any decision on your application after 4 months, you can take the silence as a refusal.

          If this happens, you have two options:

          • Get an administrative appeal before the prefect in charge of the prefecture you applied to.
          • Go for litigation in an administrative court.

However, you must show the Embassy that you have proof of domicile, which is proof that you are a legal resident in the country.
