    Introduction to UK Family Visas for Algerians

    The UK family visas will allow Algerian nationals to come to the UK and live with a family member already residing in the country. Note that a family visa is necessary if you intend to stay in the UK for longer than six months. If you’re staying for six months or less, you should apply for the Family Visitor Visa.

    The UK has different types of family visas, and the visa you will need will depend on your circumstances and relationship with your UK-based family member. Under the family visa route, you can apply to join your spouse, civil partner, fiance, parent, child, or a relative who can provide you with long-term care.

    To obtain a family visa, you must meet the strict eligibility and documentation criteria set out by the Home Office. If your application is successful, you will be able to live, work, and study in the UK. After some years in the UK, you may qualify for Indefinite Leave to Remain (ILR) and, later on, British citizenship.

    Eligibility Criteria for UK Family Visas

    If you intend to apply for a family visa, you and your UK-based family member must fulfil certain eligibility requirements.

    Requirements for the UK-based Family Member

    It’s important to note that not all UK residents can bring their family members to join them in the country. To be eligible to apply for a family visa, your UK-based relative must be any of the following:

    • A British citizen
    • An individual with indefinite leave to remain
    • An individual with pre-settled status
    • A person with refugee or humanitarian protection status.
    • A person with permission to stay as a stateless person.

    Your UK sponsor must be an immediate relative. During your application, you will be required to submit proof of your relationship with them, and you can use documents such as marriage or birth certificates.

    Additionally, your relative must provide you with a letter of sponsorship that includes information on your relationship and why they’re sponsoring you. They must also agree to support you financially for at least five years of your stay in the UK.

    Requirements for Visa Applicants

    To qualify for a family visa, you must meet the specific requirements for the type of visa you’re applying for.

    Additionally, you must meet the following general eligibility criteria:

    • Have a clean criminal record
    • Prove that you do not pose a threat to UK security
    • Prove that you can speak and understand English.

    To demonstrate your proficiency in English, you can provide an approved academic certificate equivalent to a UK degree and taught in English. Otherwise, you must pass an English language test on the Common European Framework of Reference for Languages (CEFR) scale.

    You will not be required to prove your proficiency in English if:

    • You’re applying as a child
    • You’re over 65 years old
    • You have a mental or physical disability that prevents you from meeting the requirement.
    • You’re applying as an adult to be cared for by your UK family member.

    Types of UK Family Visas

    There are several visa options for Algerians who intend to relocate to the UK to be with their family members. The different family visa types include:

    • Spouse Visa
    • Fiance Visa
    • Parent Visa
    • Child Visa
    • Adult Dependent Visa

    Spouse Visa

    The UK Spouse Visa, also called Partner Visa, is designed for foreign spouses and civil partners of British citizens and permanent residents. The requirements for this visa include:

    • You and your partner must be over 18 years old
    • You must prove that you are in a marriage or civil partnership legally recognised in the UK.
    • You must prove that you have lived together as partners for at least two years.
    • You must provide evidence that you are in a genuine relationship.
    • You must show that any previous marriages or partnerships have ended.
    • You must meet the minimum income requirement.

    To meet the minimum income requirement, you and your partner must earn a combined annual income of at least £18,600. This is set to rise to £29,000 in Spring April 2024, followed by gradual increases to £38,700.

    If you’re applying with your children, each year, you must earn an extra £3,800 for your first child and £2,400 for each child you have after your first child.

    Furthermore, if your application for a Spouse Visa is successful, you will be able to live in the UK for 2 years and 9 months. Upon expiration of your visa, you can extend it for an additional 2 years and 6 months.

      Fiancé Visa

      If you have a fiancé, fiancée, or proposed civil partner living in the UK, you can apply for the Fiancé Visa. This visa will allow you to enter the UK for the purpose of marrying or entering into a civil partnership with your proposed partner.

      To apply for a Fiancé visa, you must:

      • Prove that you intend to get married or become civil partners within 6 months of arriving in the country
      • Show that any previous marriages or civil partnerships have ended.
      • Meet the financial requirement of the Spouse Visa.

      The Fiance Visa is only valid for 6 months, and failure to get married or register your partnership within this period might lead to your removal from the country.

      During your stay on the Fiancé Visa, you will not be allowed to study or work. After your marriage, you can switch to the Spouse Visa, which gives you the right to work and study.

      Parent Visa

      If you have a child living in the UK, you might be able to apply for a Parent Visa to care for them. With a Parent Visa, you will be able to bring your other dependent children with you to the UK.

      To be eligible, your UK-based child must:

      • Be under 18 at the time of your application.
      • Not be living independently (such as being married or living away from home except for full-time studies).

      You must also meet the following requirements:

      • Have sufficient finances to support yourself, your child, and any dependent accompanying you.
      • Prove that you have sole parental responsibility for the child. If you share responsibility, the other parent must be a UK citizen or settled person and not be your partner.
      • Prove that you are actively raising your child and will continue to do so in the UK.

      Note that to apply for the Parent Visa, you must not be eligible for a Spouse Visa. Otherwise, you will have to apply for a family visa through the spouse route.

      If your application for The Parent Visa is successful, you will be able to live and work in the UK for 2 years and 9 months, and extend your stay for an additional 2 years and 6 months.

      Child Visa

      The UK Child Visa will allow dependent children from Algeria to join their parent(s) living in the UK. However, if one of your parents has indefinite leave to remain, you may not need a family visa. You can, instead, apply to settle in the UK.

      To be eligible for a Child Visa from Algeria, you must meet the following criteria:

      • Be under 18
      • Be financially supported by your parent without needing to claim public funds.
      • Live with your parents, except you live away from home for full-time studies.
      • Not be married or in a civil partnership.

      You must apply for this visa on the back of one of your parents’ applications or separately. That parent must either be:

      • The one with sole parental responsibility for you or
      • A parent applying to join their partner who is your other parent.

      Adult Dependent Visa

      If you are an adult in need of long-term care from your parent, child, grandchild, brother, or sister residing permanently in the UK, you might be able to apply for the Adult Dependent Visa.

      This visa is one of the most challenging family visas to get as it requires you to prove that the care you require is not available or affordable in your home country. You must also:

      • Be over 18
      • Not be eligible for any other family visa type
      • Prove that you need long-term care to do everyday tasks because of illness, disability, or age.
      • Prove that your UK-based relative can care for you for either 5 years or the entire duration of their permission to stay in the UK.

        Documents Required for UK Family Visas

        The supporting documents you’ll need to apply for a family visa include:

        • A valid passport
        • Two passport-sized photographs
        • A letter of sponsorship
        • Proof of your relative’s accommodation in the UK
        • Proof of sufficient funds to sponsor yourself
        • Proof of your relationship with the UK resident with documents such as birth certificate and marriage or civil partnership certificate.
        • For partners, proof of a genuine relationship with documents less than four years old that confirms that you lived or shared expenses together, including:
        • A tenancy agreement, utility bills, or council tax bills
        • A bank statement from that you live at the same address
        • A letter from your doctor or dentist confirming that you live at the same address
        • Photographs of you two together
        • Evidence of conversations you’ve had, such as phone logs, emails, and texts
        • Receipts from gifts you’ve bought each other or meals you’ve had together
        • Travel tickets from visiting each other.
        • Tuberculosis test result.

        Understanding the UK Family Visa Application Process

        To apply for a UK family visa, visit the UK government website and create an account. You will need to complete the online application form and upload your supporting documents. Also, you must pay the visa application fee and immigration health surcharge.

        You will be directed to book an appointment with a UK visa application centre (VAC) in Algeria. At your appointment, present your supporting documents and give your biometric information (fingerprints and photographs).

        The Home Office will assess your application and reach out to you with a decision.

        UK Visa Fees for Applicants

        The UK family visa costs £1,846 if you’re applying to join a partner, parent, or child. If you’re applying for the Adult Dependent Visa, here’s what you’ll pay:

        • £404 if your UK relative has refugee or humanitarian protection status
        • £3,250 if your UK relative is a UK national or resident.

        You’ll also need to pay an immigration health surcharge of £1,035 per year.
