The Different UK Work Visas For Bangladeshi

      Overview

To be allowed into the UK for work purposes, Bangladeshi citizens must obtain a UK Work visa that suits their situation and job type. Several UK Work visas are specifically designed to meet the job types of migrant workers.

Some of these UK Work visas are Long-Term and offer routes to Indefinite Leave to Remain in the UK. Whereas others do not offer routes to remain in the UK indefinitely. Below are the Long-Term and Temporary UK Work visas available for Bangladeshi citizens.

      Skilled Worker Visa

The Skilled Worker visa helps employers to sponsor foreign workers to enter the UK and work for them. This Skilled Worker visa allows migrant workers to do qualifying jobs for employers that are approved by the Home Office.

Employers who want to bring skilled migrant workers into the UK must have a sponsorship licence and are required to pay an Immigration Skills Charge. The migrant workers are required to score enough points on the Points-Based System of the Home Office.

To apply for a Skilled Worker visa, foreign workers must receive a genuine job offer, and a Certificate of Sponsorship from their UK employers. That being said, this job offer must be on the list of eligible occupations and must meet skill and salary requirements.

Bangladeshi citizens holding a Skilled Worker visa are allowed to stay in the UK for up to 5 years. Migrant workers on this visa have the option to extend their stay as long as their job remains valid and they continue to meet the requirements.

There is no limit on how long holders of the Skilled Worker visa can extend it. Note that after staying in the UK for up to 5 years on the Skilled Worker visa, the holder can apply for Indefinite Leave to Remain.

      Health and Care Worker Visa

Licensed health and care sector employers can sponsor nurses, doctors, health professionals, and adult social care professionals via this visa, to come and work for them in the UK. Applicants for the Health and Care visa must be employed in a position that qualifies and makes the required salary.

The Skilled Worker visa and the Health and Care Worker visa are fairly comparable. But the Health and Care Worker visa is a subcategory of the Skilled Worker visa, however, it has far lower costs to entice foreign healthcare professionals to work for their employers in the UK.

For this visa, sponsoring employers are still required to pay the Immigration Skills Charge, however, eligible applicants are exempted from paying the healthcare surcharge. Among some of the requirements applicants of a Health and Care Worker visa must meet to qualify is financial subsistence in the UK.

Holders of this visa are allowed to stay in the UK and work for their employers for up to 5 years and your dependents can join you on this visa. Upon the expiration of this visa, the holders can renew it and there is no length of stay for the Health and Care Worker visa. Once your 5 years stay in the UK elapses, you can apply for Indefinite Leave to Remain.

      Seasonal Worker Visa

The Seasonal Worker visa is a type of UK Temporary Work visa that helps UK employers bring foreign workers to come and work for them in the country. This visa, just as the name implies, permits a foreign national to enter the UK and engage in seasonal work.

This seasonal work is typically within horticulture or poultry production sectors for a scheme operator that is approved by the Home Office. This seasonal work typically lasts for up to 6 months. Foreign workers who want to engage in horticulture seasonal works in the UK must be 18 years old and above, and the work involved includes picking fruits or vegetables and flowers.

Bangladeshi citizens can apply and go to the UK at any time of the year to work in the horticulture sector for their UK sponsors as there is no specific period for this to happen. The seasonal work in the poultry production sector, just like in the horticulture sector can only be done by foreign workers who are 18 years old and above.

Unlike the duration of work in the horticulture sector, poultry production workers can only last from October 2 to December 31 of each year. These dates stand for the busiest and most productive times of the year for the poultry production industry, which is around Christmas.

Bangladeshi citizens interested in working as seasonal poultry workers in the UK should apply by November 15 of each year. This visa does not allow dependents to join its holder and it does not offer a route to settlement in the UK.

      Creative Worker Visa

The Creative Worker visa is a type of UK Temporary Work visa designed for Bangladeshi citizens who have obtained a short-term job offer in the UK. This visa allows a UK employer to sponsor foreign nationals who are referred to as creative workers.

The creative worker is permitted to work within the UK’s creative sector, to make a significant contribution to the creative industries of the UK, such as an actor, entertainer, musician, dancer, film crew or fashion model. The support or technical staff, otherwise known as the entourage of eligible creative workers, are allowed to accompany them to work in the UK.

Besides that, the partner or children below 18 years old can join the Creative Worker visa holder to enter the UK. This visa typically lasts for up to 12 months, and upon its expiry, the holder will have the option to extend it under the same employer for a further 12 months, thereby making the maximum stay up to 2 years.

The Creative Worker visa allows its holder to carry out a second job under the same sector, provided the job is in the Skilled Worker shortage occupation list, and on the same level as the main job for which they are sponsored. The holder of this visa is neither allowed to start their own business nor eligible to access public funds.

UK Work Visa Requirements And Application Process For Employers Bringing Bangladeshi To UK

        Overview

As a UK employer, there are some requirements you must meet before you are permitted to bring a migrant worker to come and work for you in the UK. You should first obtain a sponsorship licence.

Before you obtain the sponsorship licence, you must prove to the Home Office that your company is genuine, legally compliant and can fulfil its sponsorship duties. The Sponsorship licence will allow you to assign a Certificate of Sponsorship (CoS) to migrant workers.

After obtaining the CoS, the migrant workers can then apply for a UK Work visa to come and work for you in the UK. More elaborately, you must assure the Home Office that your company meets several eligibility requirements. You must prove that you:

        • Will comply with the background and routine checks of the Home Office.
        • Are a legitimate organisation and qualified to issue Certificates of Sponsorship.
        • Will obey the sponsor licence requirements, and also monitor your workers, keep records, and report to the Home Office should your skilled workers fail to meet the requirements.
        • Can offer an acceptable job role that will pay your skilled worker.

        Applying for Sponsor Licence

You must apply for a sponsor licence before you can bring Bangladeshi citizens to come and work for you in the UK. The sponsor licence is of two types, namely the Workers licence designed for skilled or long-term employment, and Temporary workers designed for specific types of temporary employment.

Take the below step-by-step guide in applying for a sponsor licence:

        Step 1. Get Ready

You are required to gather your sponsorship details. This includes information about your company, the roles you intend to fill, and proof that you were unable to find qualified candidates to fill that role from within the UK.

        Step 2. Apply Online

UK employers must complete a sponsor licence application form online. You can access the form on the UK government’s official website. You need to fill out the required information, such as the specific visa routes needed and the type of workers you want to sponsor.

Do not worry about the application process for the sponsor licence if you do not know how to go about it. Our immigration lawyers are readily available to assist you throughout the application process. We can even apply for a sponsor licence for your organisation on your behalf. Call us today on +44 (0)333 305 9375 or message us online for immediate assistance.

        Step 3. Pay the Fees

The sponsor licence application has an application cost. The precise price varies according to the organisation’s size and the type of licence you’re applying for.

Step 4. Bring Your Supporting Documents

After submitting your online application, you are required to forward your required documents to the UK Visas and Immigration (UKVI) office. The documents must prove that your company is authentic and is eligible to sponsor migrant workers.

        Step 5. UKVI Review

After submitting your documents, the UKVI will assess the quality of your application. In some cases, they may send some of their officials to visit your company and see how the business is run.

        • A tuberculosis test certificate.
        • Have proof of accommodation to show that you will not be stranded when you enter the UK.

These mentioned requirements are not all-encompassing, as you may be required to meet other criteria depending on your situation and the type of UK Work visa you are applying for. You are required to complete the application form and book an appointment at a visa application centre after paying your visa fee. After booking the appointment, you will receive a confirmation email of your appointment along with the required documents you must provide. For the next step of your application, you will be issued a Global Web Form (GWF).

Step 3. Fill Out Your Details on the TLScontact

You will not be permitted to attend your appointment if you do not register your details on the TLScontact website. After your registration, you may now track your application on their website.

Step 4. Prove Your Identity at the Appointment

Attend the appointment on time as your appointment may be delayed or cancelled if you are late. Also prove your identity by submitting your biometric information (photographs and fingerprints) or scanning your identity document using the UK Immigration: ID Check app.

Come along with your required documents to the appointment to avoid delays, they include visa payment receipt, original Bangladeshi international passport, online application form’s printed copy and so on. Then submit your UK Work visa application.

        Step 5. Await a Decision

After applying for your UK Work visa, you will wait for it to be processed by the UK immigration authorities. You can keep track of your UK Work visa application progress on the TLScontact website.

You should expect a decision on your UK Work visa in 3 weeks if you are applying from outside the UK. But if you are applying from within the UK, you should get a decision on the application in about 8 weeks.

Step 6. Receive Your Work Visa

Once your application has been successfully processed, you will be notified to come and pick it up at the specified visa application centre.

        Family Reunification

As a Bangladeshi citizen resident in the UK, your family members can apply as dependents to join you in the UK, provided they qualify. Your dependents are required to fill out a different application. Upon a successful application, they will receive visas that depend on yours as well because their visas will become invalid on the same day your visa expires.

Your family members will need your application number, otherwise known as the Global Web Form (GWF) or a Unique Application Number (UAN). Your dependents may use a family linking code to connect your applications if you were issued the code when you applied for the visa. Also, they are required to prove their identity by submitting their biometric information, signing into the UKVI account and scanning their identity documents using the UK Immigration: ID Check app.
