    UK Family Visas: An Overview

The UK Family visa allows Bangladeshi citizens to join a family member residing in the UK. This visa grants its holder a stay period of about 6 months and above in the UK.

If you are married to a UK permanent resident or citizen, you can also join them in the UK with your children. Additionally, if you are a partner/fiance, child or parent of a UK resident, you are also permitted to obtain a UK Family visa to enter the UK.

Your UK family member who will sponsor your move to the UK must be on a valid immigration status, that is, a visa that will permit you to join them in the UK. The reason is that not all UK visas support the idea of bringing a family member into the UK via the same route.

Several types of UK Family visas fit into various immigration categories. Bangladeshi citizens who are the spouses/partners and relatives of UK residents can use these various UK Family visas to join them in the UK.

The Different Types Of UK Family Visas

There are different kinds of UK Family visas typically designed to allow you to enter the UK depending on your relationship with your UK Family member resident in the UK. The following include the UK Family visas:

      UK Spouse Visa

The UK Spouse visa or Partner visa is a type of UK Family visa that allows a qualified individual to join their spouse or partner in the UK. It permits its holder to live, work and study in the UK.

As an applicant for the UK Spouse visa, you must have been staying with your UK-based partner in a relationship for a minimum of 2 years. You must also be married to or in a civil partnership with your UK-based partner.

You must prove that you earn a minimum of £18,600 yearly. You must also have £3,800 yearly set aside for your first child and about £2,400 for any other subsequent child. This visa allows its holder to reside in the UK for up to 2 years and 9 months.

When this duration elapses, you will have the option to extend it for an additional 2 years and 6 months. After you have stayed in the UK for up to 5 years, you may then apply for Indefinite Leave to Remain (ILR).

      Fiance visa

With the Fiance visa, a Bangladeshi fiancee, fiance or proposed civil partner of a UK-based individual can enter the UK to stay with them for up to 6 months to enter into a civil partnership or get married. The fiance or fiancee in this case must also meet the financial and English language requirements, just as stated for a UK Spouse/Partner visa.

You can apply for a UK Spouse or Partner visa immediately after you are in a civil partnership or married to your UK-based partner. The initial validity period for your stay on this visa is 2 years and 9 months, after which you can extend it for another 2 years and 6 months. Thereafter you can apply for Indefinite Leave to Remain in the UK.

      Parent Visa

If you are a Bangladeshi citizen who is a parent of a child in the UK, you can obtain a Parent visa to enter the UK and look after your child. This visa will allow you to live, work and study in the UK.

To join your child in the UK, they must not be living an independent life and be under the age of 18 at the time of your initial leave application. Before you join your child in the UK:

      • They must have settled in the UK
      • Your child must be an Irish or British citizen
      • They must have resided in the UK for a consecutive 7 years with no need to leave the UK
      • Your child in the UK, under the EU settlement scheme, must have a pre-settled status

As a parent of the child residing in the UK, you must have shared or sole parental custody of the child. The maximum stay required of you on a Parent visa is 2 years and 9 months, and it can then be extended for an additional 2 years and 6 months. When you have stayed in the UK for up to 5 years, you may then apply for Indefinite Leave to Remain (ILR).

      Family Reunion Visa

This type of UK Family visa allows its holder to join their immediate family member in the UK. They must sponsor you to come and stay with them in the UK via this route. You can qualify to be sponsored for the Family Reunion visa if you are a spouse/civil partner, child, adopted child, unmarried or same-sex partner of the UK resident.

Your family member must have been granted refugee status or humanitarian protection in the UK. After obtaining the Family Reunion visa, you can also extend your stay if you wish, and apply for Indefinite Leave to Remain when due.

      Adult Dependant Relative Visa

This visa permits an adult-dependent relative to enter the UK to be taken care of by a permanent resident in the UK. The person who will take care of the adult dependent relative could be a son, daughter, brother, sister, grandchild, or parent of the individual. This visa leads to permanent residency status in the UK.

If you want to enter the UK via the Adult Dependent Relative visa, you must prove that:

      • You cannot afford the care you need should you remain in Bangladesh
      • You are 18 years old or above
      • You are too old, sick, or disabled to do daily personal and household activities without long-term care
      • You have someone in the UK who can cater for your needs and house you for up to 5 years without needing government assistance

      Child Visa

This visa permits a child to enter the UK to stay with their parent. Note that if one of a child’s parents has a UK Indefinite Leave to Remain status, that child doesn’t need to obtain a Family visa. For this reason, the child can apply for Indefinite Leave to Remain immediately.

Whether an applicant for a Child visa is born in the UK or not largely determines the requirements they must provide. For a child born in Bangladesh, they must prove that they are neither married nor in a civil partnership but are dependent on their UK-based parents. The Child visa is also extendable and offers a route to Indefinite Leave to Remain in the UK.

      PBS Dependent Visa

The PBS Dependent visa is designed for Bangladeshi spouse and their children to join their partner in the UK. This visa will permit you and your child to also live, work, and study in the UK.

The individuals eligible for this visa include:

      • A child below 18 years old, including children born in the UK
      • A child above 18 years old who is still dependent on the UK resident
      • Civil, married or unmarried partner. If you are unmarried, you must have lived with your partner for at least 2 years in a genuine relationship

      For 16-year-old and above children:

      • They must not be in a civil partnership or married
      • They should rely on you financially
      • They should rely on you financially
      • They must live with a parent unless they are attending a college, boarding school, or university and living away from home

After obtaining the PBS Dependent visa, you will be allowed to remain in the UK for as long as the visa of your UK family member (primary visa holder) is valid. If the primary visa holder applies for an extension of stay in the UK, you will also be allowed to make the same application.

Additionally, if your UK family member applies to remain in the UK indefinitely, you can also apply to settle in the UK, provided you meet all the requirements.

Eligibility Criteria & Requirements Of The UK Family Visas

Bangladeshi citizens are required to meet some eligibility requirements of the UK Family visas. The following include the eligibility criteria. You must:

      • Be a spouse/partner or close relative of a settled person in the UK or a British citizen
      • Be a dependent partner/spouse or close relative of someone with current UK entry permission
      • Be the relative of someone who resides in the UK, if you intend to travel there temporarily
      • Be the grandson or granddaughter of someone who was born in the UK

As part of the UK Family visa requirements, you must prove that a genuine relationship exists between you and your family member who resides in the UK. To prove this, you must provide a birth or marriage certificate, a photographic proof.

You must also provide evidence of correspondence, spending time together, and living together. Ensure you bring other supporting documents as may be required.

You may be asked to prove your knowledge of the English language. But you may be exempted from proving your knowledge of the English language if:

      • You are applying as a child
      • You are over 65 years old
      • You have a mental or physical condition that hampers your chances of meeting the requirement
      • You are applying as an adult to be catered for by a relative
      • You’ve already been on a Family visa for 5 years and seeking an extension as a parent or partner

You may be required to provide a letter of sponsorship if your entry clearance requires your UK-based family member to act as your visa sponsor. The letter of sponsorship must tell how you are related to your sponsor (UK-based family member), among other details.

If you are entering the UK to join your spouse, both of you are required to have a combined £18,600 per year and extra money for each child coming with you.

        UK Family Visa Application Process

        Overview

Remember that there are different types of UK Family visas, therefore, the steps or the requirements needed to make a solid application may differ. However, the following includes details to consider in applying for a UK Family visa.

As a Bangladeshi citizen, you are required to provide the following documents as part of your application:

        • Your original Bangladeshi international passport. It must be valid for at least 6 months beyond your intended travel date.
        • Visa application form. Fill out your application form with the correct details and duly sign it.
        • Two passport-sized photographs. You should attach one photograph to your passport and the other to your application form.

Note that you may be required to bring other documents to support your application. However, you must now follow the below steps:

        Check if You Qualify

You must know if you qualify for the UK Family visa type you want to apply for. If this is the first time you are applying for a UK Family visa, you may have a hard time choosing the specific UK Family visa type that suits your situation.

For this reason, it’s best to seek expert guidance from an immigration lawyer. Our immigration lawyers at Total Law are experienced professionals who know how the UK immigration law works.

They can help you select the best UK Family visa that suits your situation and be by your side throughout your Family visa application process. Call us today on +44 (0)333 305 9375 or contact us online.

        Assemble Your Documents

You are required to bring all your required documents and arrange them properly to make an organised application. It’s not a good sign to have an untidy file document during visa applications.

        Schedule and Attend the Appointment

Thereafter, you must then schedule an appointment with the British High Commission in Dhaka. At the appointment, you will be interviewed and you will submit your biometric information (fingerprints and photographs). You will then be asked to come and pick up your visa once it has been approved.

Family Visa To Permanent Residency In The UK

After obtaining a UK Family visa to join your UK-based sponsor, you may have the opportunity to become a permanent resident. For this to be possible, you must enter the UK on a Family visa that supports permanent residency in the UK, such as a Spouse visa, Child visa, and so on.

Additionally, you are required to meet certain requirements to obtain UK permanent residency status as a family member of a UK-based resident or citizen. You must:

        • Meet the English language requirements
        • Meet the relationship requirements
        • Meet the financial requirements
        • Pass the Life in the UK test
        • Have resided in the UK for 2 or 5 years (for applicants who hold a Spouse visa)
        • Have a permanent resident in the UK who is your immediate family member (for adult dependents or child applicants)

Generally, when you remain in the UK for up to 5 years with your Family visa you may qualify to apply for permanent residency status in the UK which will allow you to stay in the country for the foreseeable future.

The Rights And Benefits Of UK Family Visa Holders

Bangladeshi citizens who hold a UK Family visa are entitled to several benefits their UK-based sponsor enjoys as a UK resident. Some of these benefits include the right to work, education, access to healthcare services from the National Health Service (NHS), and so on.
